TERMS & CONDITIONS

BOOKING:

At the time of booking, a $50 non-refundable retainer fee is required to hold your date and time. Payments can be made using a credit card, or PayPal. Appointments without a deposit will not be honored. Payment of the deposit acts as an agreement to all of The Coü,s policies. 

LATE FEE:
A $50 surcharge will be added to the client's invoice if 20 minutes late. The Coü is not liable to extend a session's time to accommodate tardiness. If the client wishes to extend time based on availability he/she may do for an additional fee per hour. If the client is late near close of business (11am-7pm), the session will be cancelled and further rescheduled.  

CANCELLATION/RESCHEDULING POLICY: 
If a client is unable to make his/her photo session all retainers will act as a cancellation fee. If there is a need to reschedule a session, a client may do so free of charge once it is requested at least 3 days (and can only be changed to a time period of up to 1 month after) before session otherwise a $50 fee will be applied. The photographer reserves the right to deny any client(s) who repeatedly have a history of cancellations. If the photographer cannot perform this contract due to fire or other casualty strike, act of God or other causes beyond the control of the parties, or due to the Photographer's illness or emergency, then the Photographer shall return the retainer fee to the client via original form of payment, but shall no further liability with respect to the contract. This shall also apply in the event that photographic materials are damaged in processing, lost through camera or media malfunction or otherwise damaged without fault on the part of the Photographer. In the event The Coü fails for any other reason, he shall be liable for any amount in excess of all monies paid.

REMINDER: ALL BOOKING RETAINER FEES, BE IT WEDDING, MATERNITY OR ANY OTHER SHOOT BOOKING IS ONLY TRANSFERABLE AND NON REFUNDABLE!

Payment

The total must be paid in full at the time of the photoshoot. Sittings that are postponed to a later date will retain the fee as long as the photographer can re-schedule for the new date and time within the same month or 4 weeks following.

Retouching

All images will be edited to the best of the photographers abilities. The Photographer's judgement regarding these corrections and the number of images put forward to the Client for preview shall be deemed correct. Retouching, digital manipulation and artist finishing is available to the Client as an option at extra cost.

CONCEPT/CONSULTATIONS:

The Coü requests for clients to have at least a brief idea or sample images for his/her concept. All clients are require to have a consultation before session whether in-person or virtual. Failure to do so, may result in no show.

IMAGE POLICY:

Proofing photos will be returned to client 1-3 business days following their session date. These are unedited images that will be watermarked and have no access to download or usage. Clients must not screenshot or share these images via social media, if shared each shared photo will be taken from the clients final retouch bunch. To inform the photographer of the images you would like edited, please create and finalize your selection at soonest. You are not allowed to make changes after selection has been finalized. There are fees if you wish to purchase an additional edit(s). The turnaround time for edits are 7-15 business days, in some cases retouched photos can take as long as 25 business days i.e. Xmas season and Mid Summer.

If you the client decides to purchase an additional edit(s), the turnaround time will begin at that date for the specific image(s). This contract also serves as a model release. The client grants the Photographer the right to use all images and footage without restriction for advertising, portfolios and other lawful purposes. The client waives the right to inspect any images produced using the images or footage from the events in this contract, and the right to restrict the use of the images or footage from the listed events by the photographer.

COPYRIGHT POLICY:

All photographs/footage are and shall remain the sole intellectual property of the photographer in accordance with United States of America and The Commonwealth of The Bahamas Copyright Laws. The client hereby waives any rights to intellectual property ownership, monetization, or reproduction of the images and footage created by the photographer, with exception f the terms of any formal written releases provided to the client by the photographer. 

By signing this document, the photographer does grant the client the right to print images for personal or family use. The photographer grants the client the right to publish photographs to social media with/without credit. If the client wishes to use images/footage for commercial, multimedia advertising, sale, etc.... the photographer will provide the documentation and invoice for such matters. The client may present this contract to photo printing companies if they request authorization from the photographer.
